ACCEPTING COMMISSIONS

1.1 Right to Refuse

I reserve the right to decline any commission for any reason without obligation explain. This includes but is not limited to:
• Content I am uncomfortable drawing
• Insufficient or unclear references
• Previous negative interactions
• Projects that do not fit my current schedule or style

1.2 Communication

Initial commission inquiries are conducted via {Bluesky DM / Email }. Once accepted, primary communication will continue through a google form. Please respond within 7 days; after this period, your commission slot may be released.

1.3 What I Draw

• Original Characters
• D&D/WOW/FFXIV characters
• Fan art
• Couples and solo portraits
• Lineart to fully rendered illustrations
Restricted – Serious inquires + requires further discussion
• NSFW/Explicit sexual content (must be 18+)
• Furries/Anthro

1.4 What I Do Not Draw

• Mecha / Heavy machinery (unless discussed)
• NFTs or AI training use
• Hate speech or discriminatory content

payment terms

2.1 Pricing & Currency

• All prices are in CAD
• Final price is determined by complexity, character count, and rendering level
• Prices are non-negotiable unless otherwise stated

2.2 Payment Methods

• PayPal (Invoice)
• Buyer assumes all transaction fees (typically +5% for PayPal)

2.3 Payment Schedule

• 50% non-refundable deposit required before work begins. Remaining 50% due before final high-resolution file is delivered.

2.4 Payment Deadlines

Invoices must be paid within 48-72 hours of receipt. Failure to pay within 7 days may result in automatic cancellation of the commission slot.

2.5 Commercial Use

Personal use only is included in standard pricing. If you require commercial rights (selling prints, merchandise, promotional use), this must be discussed before commissioning and will incur an additional fee of 100-200% of the original commission price.

REFUNDS & CANCELLATIONS

3.1 Refund Deductions

Transaction fees (PayPal, etc.) are non-refundable. Any refund issued will have fees deducted from the returned amount.

3.2 Artist Cancellation

I reserve the right to cancel a commission at any time due to personal emergency, health issues, or client conduct. In such cases, a 100% refund will be issued for all work not yet completed.

WORKFLOW & REVISIONS

• Standard turnaround: 2-6 weeks from deposit confirmation
• Complex pieces (fully part illustrations, detailed reference sheets): 6-8 weeks
• You will be notified immediately of any delays

4.2 Work-In-Progress (WIP) Updates

You will receive
• Rough Sketch for approval
• Clean Sketch / Lineart (for rendered pieces)
• Flat colour / Base colour (optional)
• Final rendering for approval before delivery

4.3 Revisions

4.4 Artist Errors

If I make a mistake that contradicts your provided reference (wrong eye colour, missing accessory, incorrect design detail), I will correct it at no additional cost, regardless of stage

4.5 Rush Orders

If you require a deadline shorter than my standard turnaround, a rush fee of +50% applies, subject to availability

INTELLECTUAL PROPERTY & COPYRIGHT

I, Lyllith, retain full and exclusive copyright of the original artwork. This includes all rights to the image file and underlying creative work.

5.2 What you (Client) May do:

• Display the artwork on personal websites, social media, profiles, or devices
• Print the artwork for personal, non-commercial use (wall art, gifts, personal collections)
• Use the artwork as an avatar, icon, banner, or header with credit given
• Crop/Resize the image for these purposes only—do not alter, edit, or filter

5.3 What you May NOT Do:

• Clain the artwork as your own creation
• Remove, crop out, or obscure my signature/watermark
• Edit, alter, trace, or heavily filter the artwork
• Use the artwork for NFTs, cryptocurrency, or AI training datasets
• Sell prints, merchandise, or reproductions unless commercial rights were purchased
• Use the artwork for commercial branding, advertising, or product packaging without separate agreement

5.4 What I (Artist) May Do:

• Post the artwork on all social media and portfolio platforms
• Use the artwork for self-promotion (prints at conventions, portfolio, advertising my services)
• Include the artwork in art books or collections
• Exception: If you require full privacy (artwork not posted publicly), inform me before payment. A +25% private commission fee may apply

5.5 Credit

When reposting, you must credit me as lyllithx3 with a link/tag to my profile. “Credit to artist” is insufficient

CLIENT RESPONSIBILITIES

6.1 References

You must provide clear, accurate visual references. Text-only descriptions are accepted but may result in design variations. For complex characters, multiple reference images are strongly recommended

6.2 Communication

Please respond to WIP updates within 7 days. If I do not receive feedback within this window, I will assume approval and proceed to the next stage. Repeated non-response may result in commission cancellation

6.3 Conduct

Harassment, pressure to rush, disrespectful communication, or demands for unreasonable revisions will result in immediate commission cancellation with no refund

DELIVERY

7.1 Final Files

You will receive:
• Full resolution PNG (unwatermarked)
• Dimensions appropriate for the commission type (typically 300dpi for print-ready pieces)
• Delivered via email / google drive / discord as agreed

7.2 File Storage

Please download and back up your files upon receipt. I am not responsible for loss of files after 90 days from delivery.

DISPUTES & LEGAL

8.1 Governing Law

This agreement shall be governed by the laws of Canada / British Columbia. In the event of a dispute, both parties agree to seek good-faith resolution before pursuing legal action.

8.2 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT

By commissioning me, proceeding with payment, or submitting a commission form, you acknowledge that you have read, understood, and agreed to these Terms of Service in their entirety.
